Huffington Post; American Horror Story: Children Are Being Housed In Adult Prisons Across The Country. It Has To Stop.

Article: http://www.huffingtonpost.com/2015/07/01/children-in-adult-prison_n_7702012.html

“Reading Dana Liebelson’s investigation into the treatment of children in America’s adult prisons, one entirely irrational thought occurs over and over: Somebody needs to send in a SEAL team that can land on the prison roof, shimmy inside and rescue these kids before any more harm is done to them.

Of course, the kids aren’t being held by a hostile foreign government or a rogue terrorist group, but, in this particular case, by the state of Michigan. The sense of urgency, however, is real, driven by the kinds of stories Liebelson uncovers: a boy who says he was repeatedly sexually assaulted by grown men he’s forced to bunk with; a girl manhandled in a cell extraction captured on video; a lack of any focus on educational or rehabilitative services; the casual use of solitary confinement; kids attempting suicide in the most horrific ways. And for what?

The overincarceration of people in American society has reached pathological levels, but for the same treatment to be meted out to children demands immediate intervention. Liberals, conservatives and libertarians are all coming together to call for comprehensive criminal justice reform, and the movement’s progress is impressive and hopeful. But there is a long way to go, and these kids can’t wait.

Some of the young people in Liebelson’s story are involved in a lawsuit against the state, asking to be “housed in a safe environment free of sexual assaults, sexual harassment, and physical violence perpetrated by adult prisoners and/or staff.” That they’ve done so takes an inspiring depth of courage, given allegations that Michigan corrections staff retaliate against those who complain. And not just prisoners: A special agent with the state attorney general’s office followed Liebelson to two separate prisons to serve her twice with subpoenas for her notes of her conversations with inmates incarcerated as kids.

If these kids can face down an adult prison system, surely federal and state officials can find the political courage to make at least some simple changes that inch us closer to a civilized society. Here’s where we suggest they start.

1. Keep kids out of adult prisons.

“The science is pretty clear; at 21 and under, your brain is not yet mature,” said Margo Schlanger, a civil rights lawyer and University of Michigan law professor. With that being the case — and we all know intuitively, even outside of the science, that it is — people 21 and under simply shouldn’t be in adult prisons.

2. Focus on education.

The Individuals with Disabilities Education Act can apply to anyone 21 and under, and requires, broadly speaking, the state to afford a decent education to the kinds of kids locked up in prison. For a variety of reasons, this doesn’t always happen when children are stuffed into adult correctional facilities.

3. Stop using solitary confinement.

Solitary is brutal for anyone, but for a kid whose brain is still developing and identity is being formed, days, weeks, months or years of isolation can do irreversible damage. And it doesn’t work. “Being alone is just really counterproductive for trying to get a grip on behavior,” Schlanger said. If isolation is to be used on children, she said, it should be done in increments of “hours rather than days.”

4. Don’t use cell extractions except for life-saving purposes.

Cell extractions — in which a bunch of burly guards charge into a cell after dousing it with chemical spray, and start welding electric shields and stun guns — are barbaric. And it’s often done simply because the kid wouldn’t give his lunch tray back. Anyone with children knows mealtime is ripe for conflict, as it’s one moment where kids can exert some control over their lives. Instead of terrorizing the children, guards could perhaps tell them they don’t get dessert until they return the tray.

5. Better prepare kids for re-entry.

Someone who spent their formative years in an adult prison is not going to smoothly re-enter society — considering that for them, they are not re-entering, but entering for the first time. Investment made at this moment will be returned many times over.

6. Stop locking up so many children.

Some 6,000 young people are locked in prisons and jails, according to the most recent count. “For what?” Schlanger wondered. “Nobody can tell you a story about why that’s better for the world.”

Liebelson’s investigation is produced by HuffPost Highline, a longform unit which publishes one in-depth feature per week. It’s edited by Rachel Morris and Greg Veis, with fact-checking by Raillan Brooks and multimedia by Emily Kassie. All I Feel Right Now Is Shame: The High Cost of Marriage “Equality”

“As certain LGBT people have been welcomed into the fold of the US nation-state with certain benefits and privileges of citizenship and white supremacy (property and inheritance rights, access to health care, tax benefits, and, with today’s decision, likely immigration rights as well), others – especially people of color and poor people (including queer and trans people for whom race and class oppression largely render the benefits enjoyed by some LGBT folks meaningless) – continue to face increasing marginalization and criminalization at the hands of police, prisons, and the ever expanding border security state, as well as a lack of access to basic needs such as shelter, food, education, movement (frequently denied to both queer and trans citizens and non-citizens), and health care”

Two days ago, an undocumented Latina transwoman risked her own personal well-being to disrupt a self-congratulatory love fest between so-called LGBT leaders and Barack Obama, an event celebrating the “success” of the inclusion of some lesbian and gays into the fold of US citizenship. Jennicet Gutierrez interrupted Obama’s press conference, calling attention to the abuses of the US immigration detention system, including the disproportionate harms experienced by LGBTQ people caught up in the system. This was the response of Obama and the LGBT leaders in the room:

Obama scolds Gutierrez, saying “shame on you,” and calls security to escort her from the room. The mostly white LGBT leadership in the crowd outright boo and hiss at her, and cheer Obama’s dismissal of Gutierrez and her concerns, chanting over and over: “Obama! Obama! Obama!”

Today, those same LGBT “leaders” are celebrating yet another favorable same-sex marriage decision from the US Supreme…

Police went to the suspect’s condo. The man came out of his residence holding a knife and refused orders to drop the weapon, Rorrison said.

Team 10: Lawsuit claims SDPD wrongly arrested and assaulted 20-year-old woman – 10News.com KGTV ABC10 San Diego

http://www.10news.com/news/team-10-lawsuit-claims-sdpd-wrongly-arrested-and-assaulted-20-year-old-woman
“Christina Dorsey said, “They automatically think you’re the suspect, especially when it comes to my skin color.”

A 20-year-old woman has filed a lawsuit against the city of San Diego, the San Diego Police Department and several of its officers over an incident last year.

Christina Dorsey told Team 10 SDPD officers physically assaulted and falsely arrested her in the early morning hours of July 20, 2014.

“I was crying every night. Every five seconds, I was crying. I couldn’t believe I was in jail,” Dorsey said.

Dorsey and her friends returned from Mexico when her friend and the friend’s boyfriend got in a fight in a San Ysidro parking lot. The lot attendant then called police.

Officers arrested Dorsey’s friend, but then they approached Dorsey’s car. She said police told her to get out of the vehicle, but did not say why.

“If he gave me a reason to get out of the car, I would have gotten out of the car,” Dorsey said.

They asked for her ID, which she gave to the officers. However, Dorsey said they later “physically grabbed” her and pulled her from the car when she did not exit the vehicle. The lawsuit says the officers slammed her “facedown into the ground.”

“All I remember is I ended up on the floor. His knee was on my neck,” Dorsey said. “I was in a headlock, too, in the process.”

Photos a few days later showed some of the scars on her shoulder and her elbow.

Dorsey’s attorney, Gerald Singleton, said police already took someone else into custody when the officer grabbed Dorsey.

“They can’t hold her there to try to compel her to make a statement. That is clear violation of the Constitution,” Singleton said.

Police arrested Dorsey, and she was charged with four misdemeanors, including resisting arrest and battery on an officer. She fought the charges and a jury found her not guilty on all counts.

“The officers came in response to a call, which was legitimate. However, the way they treated Christina had everything to do with her age, her race and where she was,” Singleton said.

Dorsey said she lost her job as a result of the arrest because she spent two days in jail. Dorsey told Team 10 she had never been arrested before last year’s incident.

“They automatically think you’re the suspect, especially when it comes to my skin color,” Dorsey said.

San Diego police did not return Team 10’s request for a comment.

A spokesperson with the San Diego City Attorney’s Office said they are reviewing the case but could not comment further.”

Israeli soldier posts Instagram image of Palestinian child in crosshairs of rifle | World news | The Guardian

http://www.theguardian.com/world/2013/feb/18/israeli-soldier-posts-instagram-palestinian
“An Israeli soldier has sparked outrage by posting a photograph appearing to show the back of a Palestinian boy’s head in the crosshairs of his sniper rifle on a social networking site.

The context of the picture, posted on the personal Instagram site of Mor Ostrovski, 20, could not be verified but the aggressive message is clear. The minarets and Arabic architecture of the village captured in the background suggest the boy and the town are Palestinian. Ostrovski is an Israeli soldier in a sniper unit.

The Israeli military said the soldier’s commanders were investigating the incident. His actions “are not in accordance with the spirit of the IDF [Israel Defence Forces] or its values”, a spokesperson said.

Ostrovski, who has closed his Instagram account, told the army he did not take the picture but found it on the internet.

Breaking the Silence, an organisation of veteran Israeli combat soldiers campaigning to raise awareness about life in the West Bank, condemned the image. “This is what occupation looks like. This is what military control over a civilian population looks like,” one member wrote on the group’s Facebook page.”
